1. Acceptance of Terms
By accessing this website and engaging in trade discussions, wholesale orders, or customized milling request inquiries, you agree to comply with and be bound by these Terms of Service, all applicable laws, and regulations of export authorities.
2. Bulk Wholesale & Custom Orders
All price estimations are issued subject to product availability and agricultural market fluctuations. A binding trade agreement is formed only upon formal signing of a purchase contract. Minimum Order Quantities (MOQs) start at 500 KG domestically and 1 MT internationally.
3. Logistics & Port Dispatches
International dispatches are coordinated via Kandla Port (INIXY), Mundra Port (INMUN), or JNPT (INNSA). Unless otherwise stated in the contract, terms are standard FOB (Free On Board) or CIF (Cost, Insurance, and Freight). Risk passes to the buyer upon container loading at the Indian port.
4. Payments & Financial Terms
Payments are processed securely via Telegraphic Transfer (T/T) or confirmed, irrevocable Letter of Credit (L/C) at sight. All transaction fees, import custom duties, and destination taxes are the sole responsibility of the importer/buyer unless contractually agreed upon.
5. Purity Warranties & Claims
We warrant that all products meet the specifications listed in the NABL lab Certificate of Analysis (COA) supplied with the batch. Claims regarding quality differences, purity issues, or packaging damages must be logged in writing within 15 days of shipment arrival at the port of destination.
Governing Law & Dispute Jurisdiction
Any commercial dispute, trade litigation, contract difference, or claims arising from transactions with Harvest & Co. shall be governed by, and interpreted in accordance with, the local laws of the State of Gujarat, India. Both parties submit to the exclusive jurisdiction of the competent courts in Sidhpur, Gujarat for any arbitration.
Force Majeure Sourcing Exemptions
Harvest & Co. is not liable for trade delays, shipment cancellations, or agricultural product failures arising from circumstances beyond control. This includes severe monsoon failures, crop pest outbreaks, domestic strikes, port lockdowns, changes in Indian export rules, or global shipping container shortages.
Amendments to Terms
We reserve the absolute right to revise and modify these Terms of Service at any time without prior individual notifications. The updated terms will be active immediately upon upload to this page.
